I agree with ADGUY, contact Dave I believe he'll make it right with you. I've spoken to him a few times and my take is he's a stand up guy.

I’ve bought many things from KDI and always impressed with how close to oem Dave makes things. My guess is you didn’t receive the correct part or someone has the wrong air box on your bike.

edit…the spongy part of the filter may stick out a little past the end and when the cover goes on it makes a good seal.

The air box is completely standard and hasn’t been modified.

I sent photo’s of the skewed air filter cage to Dave and he said that he would refund me. 
Thanks Adguy - the photo you sent me has inspired me to make my own out of metal mesh sheet.
